These Terms of Service ("Terms") govern your use of Tallyfeed, the social media planning and scheduling app at app.tallyfeed.com, and the website at tallyfeed.com (together, the "Service"), provided by TALLYFEED LLC ("Tallyfeed", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you agree to them on its behalf.
Tallyfeed lets you create workspaces, invite teammates, connect your social media accounts, write and schedule posts, publish them to the accounts you connect, discuss posts with your team, and see how published posts performed. We are continually improving the Service, so features may change, and it may occasionally be unavailable.
You must be at least 16 years old to use the Service. You are responsible for keeping your login details secure and for everything that happens under your account. Give us accurate information, and tell us at support@tallyfeed.com if you think someone has accessed your account without permission.
The person who creates a workspace is its owner and can invite members, change their roles and remove them. Members can see the workspace's posts, media, comments and connected accounts, and editors can create and publish posts with them. Only invite people you trust to act on your behalf.
When you connect a social media account, you authorize Tallyfeed to publish the posts you or your teammates create to that account, and to read the results of those posts. You must have the right to connect and post to every account you add. Your use of each social network remains subject to that network's own terms and policies, and we are not responsible for how a network handles your content or for changes to its services. You can disconnect an account at any time.
You keep all rights to the captions, images, videos, comments and other content you add to Tallyfeed ("Your Content"). You give us a limited permission to store, process and transmit Your Content only as needed to provide the Service, including publishing it to the accounts and at the times you choose. You are responsible for Your Content and confirm that you have the rights needed to post it.

We may remove content or suspend accounts that break these rules.
We work hard to publish posts on time, but publishing depends on the social networks and our providers. Posts can be delayed or rejected, for example when a network is unavailable, an account is disconnected, or content does not meet the network's requirements. Tallyfeed shows you when a post fails and why, where the network tells us. Please check important posts.
New accounts start with a 7-day free trial. No credit card is required to start the trial. To keep using the Service after the trial, you will need to choose a paid plan; we will show you the price before you subscribe and will never charge you without your agreement. You can cancel at any time, and cancellation takes effect at the end of your current billing period.
Our Privacy Policy explains how we collect and use personal information, including information we receive through Google sign-in and from connected social accounts.
You can stop using the Service and delete your account at any time from Account settings. We may suspend or end your access if you break these Terms, if required by law, or if we discontinue the Service; where reasonable, we will give you notice and a chance to export Your Content.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the extent permitted by law.
To the extent permitted by law, Tallyfeed will not be liable for any indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$100. Some jurisdictions do not allow these limitations, so they may not apply to you.
We may update these Terms from time to time. We will post the new version here with a new "Last updated" date and, for significant changes, let you know by email or in the app. Continuing to use the Service after changes take effect means you accept them.
These Terms are governed by the laws of the State of Wyoming, USA, and you submit to the exclusive jurisdiction of the courts located there.
